1. Introduction
Welcome to VisuBox by Vieweri 3D Technologien! These Terms of Service ("Terms") govern your use of our website located at visubox.ai (the "Service") and our 3D visualization platform for advertising technology, trade show design, and signage solutions. These Terms form a binding contractual agreement between you, the user of the Service and us, Dyadic Games GmbH (operating as Vieweri 3D Technologien), the provider of the Service.
By using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.
2. Eligibility
To use our Service, you must be at least 18 years old and have the legal capacity to enter into a binding contract. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
3. Use of the Service
You agree to use the Service only for lawful purposes and in accordance with these Terms. You are responsible for all your activity in connection with the Service, including any 3D models, designs, or content you upload or create using our visualization tools.
You agree not to:
- Violate any applicable local, state, national, or international law or regulation.
- Infringe upon or violate our intellectual property rights or the intellectual property rights of others.
- Upload or create content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable.
- Use the Service to create visualizations for illegal products or services.
- Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which, as determined by us, may harm Dyadic Games GmbH or users of the Service or expose them to liability.
- Use the Service in any manner that could disable, overburden, damage, or impair the Service.
- Attempt to reverse engineer, decompile, or extract the source code of our 3D visualization algorithms or proprietary technology.
4. Intellectual Property
The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Dyadic Games GmbH and its licensors. This includes but is not limited to our 3D visualization technology, algorithms, trade show planning tools, signage configurators, and AI-powered photo integration features. The Service is protected by copyright, trademark, and other laws of both Austria and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Dyadic Games GmbH.
User Content: You retain ownership of any designs, 3D models, images, or other content you upload to or create using the Service. However, by uploading content, you grant us a limited, non-exclusive license to use, process, and display such content solely for the purpose of providing the Service to you.
5. User Accounts
If you create an account with us, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
6. Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
If you wish to terminate your account, you may simply discontinue using the Service. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
7. Governing Law (EU Specific)
These Terms shall be governed and construed in accordance with the laws of Austria, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.
Disputes arising from these Terms will be resolved by the competent courts of Austria. For consumers, this means you can bring a claim to enforce your consumer protection rights in connection with these Terms in Austria or in the EU country in which you live.
The European Commission provides for an online dispute resolution platform, which you can access here: https://ec.europa.eu/consumers/odr. We are not obliged or willing to participate in an online dispute resolution procedure.
8. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
